Sales Conditions

 

Before any commercial transaction, the customer or client agency (from now on known as Customer/Agency) commitments to subscribe, in its entirety, to the terms and conditions mentioned in the " General Conditions of Sales" of Indochina-Land (from now on known as IL).

These general conditions of sales are an integral part of the all contracts, either verbal or written, between These general conditions of sale are a part integral of the contracts, verbal or written between IL and the Customer/Agency.

Price Validity

All prices mentioned on IL products are in USD or in EURO as indicated in earlier discussions between IL and the Customer/Agency.

These prices are valid for the whole length of time mentioned on the receipt or any other document given to the Customer/Agency by IL.

IL guarantees the validity of the prices, receipts or documents given to the Customer/Agency at the moment of their distribution but the price lists can be the object of an adjustment in certain cases of force majeure (important fluctuation of currency exchanges rates, new Governmental Sales tax suddenly announced, etc.).

Reservation and confirmation

All the bookings are made at the head office of IL or in an agency of sale appointed by IL.  Immediately after booking confirmation, a deposit of 30% of the total amount of the tour must be made, the remaining amount will be settled upon arrival to Vietnam or, at the latest, at the beginning of the tour, without a reminder from IL.  Should the opposite occur, IL reserves the right to cancel the journey and to keep the totality of the deposit already paid by the Customer/Agency. Upon the confirmation of the services, a Fax or E-mail invoice will be sent to the Customer/Agency by IL.

For legitimate reasons (floods, sudden interruption of airline services, etc.) or other cases of force majeure, IL reserves the right to change or to modify the Customer/Agency’s program, with or without prior announcement.

 Upon reception of the deposit, a receipt will be sent to you by fax or e-mail and holds place of confirmation of your booking.

* Note:  

During the banking transfer of the deposit, the banking institutions normally hold a service charge. The price confirmed by IL for the services delivered don’t included those services charges. Therefore, you are responsible for those service charges and they will have to be considered when settling the balance, once arrived in Vietnam.

For the payment of the balance and the banking charges incurred during the transfer of the deposit, credit cards are accepted, though an additional 3% commission will be applied. Our preference is the payment in EURO or USD (CASH)

Cancellation
1. Cancellation by the Customer/Agency

Should the Customer/Agency decide to cancel the booking, no matter the reason, the Customer/Agency agrees to pay a cancellation fee as follows:

  • 30% of the deposit for any cancellation made 16 to 30 days prior to the beginning of the tour;

  • 50% of the deposit for any cancellation made 7to 15 days prior to the beginning of the tour;

  • 100% of the deposit for any cancellation made less than 7 days prior to the beginning of the tour.

This rules is applied to all services reserved by IL for the Customer/Agency.  The return of the deposit (minus the applicable cancellation fees) to the Customer/Agency will be done by banking transfer.  The Customer/Agency is once again responsible for the service charges applied by the banking institutions during the funds transfer.

2. Cancellation by IL
IL can cancel contracts for any reason linked to cases of force majeure (political or sanitary reasons, natural catastrophe, airline service disruption, etc.).  In these cases, the Customer/Agency will be fully refunded but can’t ask for any form of compensation or indemnity.

Insurance - Assistance

IL is a receptive travel agency and doesn’t take care of Personal Insurance, Travel Insurance or Assistance.  It is strongly recommended that you sign up for insurance in your country prior to coming to Vietnam.  Nevertheless, will play the role of local intermediary between you and your Insurance company, should the situation require it.  Please inform us about your insurance policy in case of need.

Responsibility

IL commits to supply the Customer/Agency with all the services mentioned in the sales contract.  During the length of the tour, the Customer/Agency has to respect the regulations announced by the guide or by the service provider. 


IL is responsible towards the Customer/Agency as intermediary between the Customer/Agency and the various service providers (planes, hotels, transport operators, restaurants, boats, etc.). In each case, IL has to do its best to satisfy the Customer/Agency, but should not be confused with the various service providers, which, in all cases, keep their own responsibility.

All that takes place outside of the tour or contract between IL and the Customer/Agency is not under IL ‘s responsibility.

Disputes

In case of disputes, both parties have to look for a satisfactory settlement. In case of disputes and\or complaints, the " International Center of Arbitration of Vietnam " a branch of the "Chamber of Commerce and Industry of Vietnam " will be only competent authority.

All the complaints must be submitted in writing at the latest 30 days after the end of the services supplied by INDOCHINA-LAND.
